1. Acceptance of Terms

By accessing or placing an order through the 8 Ball Performance website (8ballperformance.com.au), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this website or place an order.

2. About Us

8 Ball Performance is an Australian-owned business specialising in heritage parts, performance accessories, and merchandise for classic Harley-Davidson motorcycles. We are based in Adelaide, South Australia.

3. Orders and Payment

3.1 All orders are subject to availability and confirmation of the order price.

3.2 We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, suspected fraud, or unavailability of stock.

3.3 Payment must be made in full at the time of ordering. We accept major credit cards, debit cards, and the following Buy Now Pay Later (BNPL) services: Afterpay, Zip, and Klarna. Use of BNPL services is subject to the terms and conditions of those providers.

3.4 All prices are displayed in Australian Dollars (AUD) and include GST where applicable.

4. Pricing

4.1 We reserve the right to change prices at any time without notice.

4.2 In the event of a pricing error, we will notify you before processing your order and give you the option to proceed at the correct price or cancel your order for a full refund.

5. Shipping and Delivery

5.1 We ship Australia-wide. International shipping is not currently available.

5.2 Shipping costs are calculated at checkout based on the size, weight, and destination of your order. 

5.3 In-stock items will be dispatched within 7 business days of the order being placed. We will notify you as soon as practicable if there is any delay to your dispatch timeframe.

5.4 Once dispatched, delivery timeframes are determined by the carrier and are outside our control. Estimated delivery times provided at checkout are a guide only and are not guaranteed. 8 Ball Performance is not liable for delays caused by third-party carriers, weather events, or other circumstances outside our control.

5.5 You will receive a shipping confirmation email with tracking details once your order has been dispatched.

5.6 Risk of loss and title for products passes to you upon delivery to the carrier.

5.7 It is your responsibility to ensure your delivery address is correct at the time of ordering. 8 Ball Performance is not responsible for orders delivered to an incorrect address provided by the customer.

6. Returns and refunds

Please refer to our Refund Policy below for full details. In summary, we do not accept change of mind returns. Returns are accepted only for items that are faulty, damaged in transit, or incorrectly supplied.

7. Product Descriptions and Compatibility

7.1 We make every effort to ensure product descriptions, images, and compatibility information are accurate. However, we do not warrant that descriptions are complete, current, or error-free.

7.2 It is the customer's responsibility to verify that any part or accessory is compatible with their specific motorcycle before purchasing. If you are unsure, please contact us prior to ordering.

7.3 Installation of parts and accessories should be carried out by a qualified motorcycle mechanic. 8 Ball Performance is not liable for any damage, injury, or loss arising from incorrect installation.

8. Limitation of Liability

8.1 To the fullest extent permitted by Australian law, 8 Ball Performance's liability to you for any loss or damage arising from your use of our website or products is limited to the amount paid by you for the relevant product.

8.2 We are not liable for any indirect, incidental, special, or consequential loss or damage.

8.3 Nothing in these terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (ACL).

9. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

10. Intellectual Property

All content on this website including text, images, graphics, and logos is the property of 8 Ball Performance and may not be reproduced, distributed, or used without our express written permission.

11. Privacy

We collect and handle personal information in accordance with our Privacy Policy and the Australian Privacy Act 1988. We do not sell your personal information to third parties.

12. Governing Law

These Terms and Conditions are governed by the laws of South Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia.

13. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Your continued use of the website following any changes constitutes acceptance of the new terms.
